These are the terms and conditions governing use of the Smallsite Design software.
Smallsite Design is a convenience for making and presenting public content.
By installing Smallsite Design you implicitly agree to these Terms and conditions.
1 Terms
△Terms applying throughout the conditions.
- 1."Software" – the program code and associated data files supplied.
- 2."Licensee" – the person or legal entity who knows the License Code, and who controls either the domain name nominated during initial installation of Smallsite Design or any subsequent single domain name that the software is fully and completely transferred to.
- 3."Licensor" – Patanjali Sokaris, who is the original copyright holder for the Software, or whomever has been explicitly and in writing granted ownership of those copyrights by inheritance or donation or sale, by them or subsequent owners.
- 4."License Code" – string of a specific format provided by the Licensor.
2 Transfer
△There are specific means by which licences can be transferred.
- a.A Licensee may transfer a License Code once, provided the recipient agrees to these terms.
3 Legal jurisdiction
△Jurisdictions of disputes relating to the Software, License Codes or Smallsite Design.
4 Limits of liability
△Liability for the Software.
- a.The Software is offered on a best-effort as-is perpetual non-exclusive basis.
- b.The Software is intended for the creation and management of public information and is not suitable for mission‑critical or safety‑critical use.
- c.The Licensor makes no guarantees regarding the Software's functionality, uptime, security, or fitness for a particular purpose.
- d.The liability for any disputes about the Software or its operation is limited solely to its purchase price.
- e.Subject to reasonable circumstances, the Licensor undertakes best efforts to provide a timely new version that remedies faulty operations of the Software.
- f.The Licensee is solely responsible for all content created, stored or published using the Software.
- g.The Licensee is responsible for ensuring the content does not violate applicable laws.
- h.The Licensee indemnifies the Licensor for any claims arising from the Licensee’s use of the Software or the actions of the Licensee’s nominated users.
- i.If any of the conditions in this document are precluded or modified by the consumer laws of the jurisdiction of the Licensee, the remaining conditions continue in full force.
5 Availability of the Software
△Conditions applying to availability of the Software or its materials.
- a.No person shall cause the source code of the Software or its included materials to be published by any means without explicit permission of the Licensor in writing.
