This site is subject to several conditions of use and privacy policies.
1 Site use△
- a.I retain all copyrights in all the content that I created that is displayed on this site. Publication here does not transfer or assign any rights to anyone else.
- b.If JavaScript is enabled in your browser, after 30 seconds of viewing a page, the current timestamp, page identifier and locale are sent to this site for reading statistics. Other than the later timestamp, no additional data is collected beyond what was used to render the page initially. No personal or other information is recorded for these statistics.
2 Privacy policies△
- a.Unless otherwise stated, information you provide to me will not be disclosed to any other person or organisation, unless legally obliged to do so.
- b.I am not responsible for the privacy of information you provide to third-party sites.
- c.This site does not leave cookies or any other files on your device when using the public pages.
- d.This site uses cookies to maintain session logins, and will be deleted when those sessions end. Do not log in if not wanting to allow cookies.
- e.By default, your browser will send some information that may possibly be used to identify you, like your IP address, to this web server, which will automatically keep logs with that information. These logs are deleted at the end of a month. You are responsible for ensuring your browser does not transmit information you do not want it to.
- f.Users enlisted by the site owner to create content can edit and delete their stored details at any time.
3 Unpublished works△
- a.They are protected by copyright.
- b.To view one of the works, you must have been explicitly given the URL to access it and the access password by the copyright owner.
- c.If you have been explicitly authorised to view the works, you may privately do so up until they are no longer accessible on the site, after which you must destroy all copies in your possession.
- d.If you have not been explicitly authorised to view the works, immediately destroy all copies.
- e.You may not allow any other person to view the works, nor distribute it to them in any form or by any means.
- f.You must not let anyone else know the existence or nature of the works.
4 Product usage△
- a.The "Product" is called Smallsite Design.
- b.The "Seller" is FastSpring, of 801 Garden St, Santa Barbara, CA 93101, USA, exclusively.
- c.The "License" is the license number provided by the Seller upon sale of the Product, and is included on the invoice and in an email sent to the Buyer by them.
- d.The License is perpetual, but can be used by anyone who knows the License to register a domain with it if there is none already, or deregister its domain if they have access to a site using the Product. However, only those who control the domain and have access to its server's web interface have the ultimate ability to control access to the site.
- e.If upon purchase, an email is received without a License, it means that none was received by the Seller, resulting in the sale being automatically cancelled within three business days and the payment refunded.
- f.The "Buyer" is the one who bought the Product from the Seller, and has received a License from them.
- g.The Product is meant for producing public-facing non-life-critical pages. Other usage is at your own risk.
- h.The Product is designed to include the latest security facilities, but it will likely not deter an extremely determined hacker, especially if state-backed. That is, the security will largely depend upon the security of the hosting provider and the site owner.
- i.The Product is designed to run on sites managed by cPanel 100+, and using PHP 8.0+. The Product is not warranted against issues resulting from bugs in those programs.
- j.There must be no other programs relying upon control of the files in the root folder of the site, nor interfering with the Product's files.
- k.The jurisdiction for any disputes is the Australian Capital Territory, Australia, and any liability is limited to the cost of the License.
- l.Any dispute notices should be made via the Report option of the Contact page of https://smallsite-design.com/. Include the last 32 characters of the License, the domain name of any site registered to it, and the nature of the dispute. No other information is required as customer contact details are stored at FastSpring.
5 Refunds△
- a.A refund is only available to the Buyer.
- b.Within 30 days of purchase, a refund is available with no reason required.
- c.Within 31 to 90 days of purchase, a refund can be requested if the the site built with the software does not work as specified.
- d.A refund must be requested from the Seller using their process.
- e.Once a refund is issued, the License will be deactivated. Any site that was relying upon it will continue to operate, though with an indication that it is not registered, but cannot be updated unless another License is purchased to register the site with.
